Coaching Agreement, Terms & Conditions

Take the time to read this, please! You’ll get way more out of your mentorship and it’s important that we are on the same page when working together as the Cain Collective LLC (me) and Client (you).

RESPONSIBILITY

*Your Coach will do everything possible to support you in achieving your own results and desired outcomes

You are responsible for the cause of all change in your life.

*Your Coach will work with you to identify solutions and offer suggestions, options and advice based on their own personal experience, training and the information appropriate

*You accept full responsibility for all decisions and courses of action

*You as Client, by signing this Coaching Agreement agree and acknowledge that the Coach is not a licensed investment advisor, real estate agent, accountant, finance, health or legal professional.

CONFIDENTIALITY

Your Coach will not divulge that you are in a coaching relationship without your express consent. You, of course are free to discuss the coaching relationship with anyone at anytime.

SCHEDULING

All Coaching Sessions are scheduled in advance by direct agreement between you and your Coach. If for any reason you cannot attend a scheduled Coaching Session you are fully responsible for informing your Coach and arranging an appointment at least 48 hours in advance, otherwise the session will be deemed forfeit. You are responsible for rescheduling via phone or contact (and receive reply) via email.

TASKING

Tasks are assigned to assist in accelerating your change and the achievement of your desired results.

FREE EMAIL ACCESS

Your Coach is available during the week via email to share wins, seek clarity on actions or review minor issues. Again, there is no charge for any of the brief “catch up emails”.

Terms & Conditions

Read these too! They are part of your agreement with Cain Collective.

If you wish to cancel the agreement and payments within 5 business days of the date indicated you may do so for a full 100% refund of any monies paid less the cost of any products delivered. This refund is only available if services have not commenced in any way rendering any refund void.

Notice of cancellation

All notice of cancellation must be in writing and delivered by mail or email to hello@momtova.com. Cancellation notice will be deemed on the date in which it is received by the Cain Collective. No refunds available for no-shows.

Terms of Coaching

The Coaching Programs are created and sold as whole packages and cannot be altered or partially completed in any way. If you are enrolled in continuing Coaching for a number of sessions, unused sessions due to quitting the program may not be eligible for refund, credit or transfer.

Suspending Membership

Is not possible after your program is in progress.

Coaching Calls

1:1 coaching calls with your Coach during your membership are at the Client’s expense, and initiated by the Client.

Payment Plans

An N.S.F. or credit card decline will result in a penalty in cases of payment default.

Privacy Policy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Program Changes

The Coach reserves the right to change, modify or cancel any programs as considered necessary. Any such change will be made in consultation with the Client.

Intellectual Property

All material relating to the Program is subject to copyright and intellectual property rights. No materials may be recorded or reproduced without the written permission of the owner.

Indemnification

You understand that all action taken is performed voluntarily and is your own responsibility. Clients should seek independent professional advice before undertaking any physical, business or investment actions.

Agreement Section

By entering into a Coaching Agreement either through signing a Coaching Agreement with the Cain Collective or paying any amount to the Cain Collective, you agree to abide by the terms and conditions as set out above.

SMS Service

Program Name: Updates related to The Cain Collective LLC programs and offers.
Description: Receive notifications, updates, and marketing offers related to the VA Leadership Academy.
You can cancel the SMS service at any time. Simply text "STOP" to (218) 304-7316. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
If you experience issues with the messaging program, reply with the keyword "HELP" for more assistance, or reach out directly to (218) 304-7316.
Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for messages sent to you from us and to us from you.
Message frequency varies, but you will typically receive 1-2 texts per month. For questions about your text plan or data plan, contact your wireless provider.

Rescheduling & Cancellation Policy

Please read these Rescheduling & Cancellation Policy carefully before using the Industry Leader (the “Service”) operated by The Cain Collective (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Policy:

The $97 fee is non-negotiable and non-refundable.

Rescheduling requests made on the day of the scheduled call, which also require a new booking, will be subject to a $97 charge for calendar re-entry.

Rescheduling is permissible without incurring a fee only if the request is made prior to the scheduled sales call day. However, rescheduled appointments must be booked within the same week, contingent upon availability, to avoid the imposition of the $97 fee.

Multiple instances of 2 or more reschedules and/or cancellations of scheduled calls may lead to permanent blacklisting from further engagements with The Cain Collective.
